`tlbiel' instruction still breaks POWER3 on 2.6.0

I know this has been discussed before. Stock 2.6.0 won't boot power3
because of the infamous 'tlbiel' instruction stuff.
'arch/ppc64/Makefile' is also hardcoded to power4 via -mcpu=power4. I
know about the workaround and have gotten a kernel to boot. Is there a
rolled up patch in another ppc64 tree (ameslab, rsync)? Could we get it
pushed into 2.6?
