Right. But firmware could parse the nvram settings and adjust the device
tree accordingly.
Anyway, that's mostly a matter of preference. I would think it's easier
to maintain the data structure compatibility between firmware and
the host-side driver, than between the linux kernel and the host-side
driver. Especially in case of changes/upgrades in the future. But then
I don't know how you package things and how much you expect to change
things over time.
